Event Waiver Form
RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT ("AGREEMENT")
This Agreement is effective as of Month "________________", 2021, and is entered into between Juvenile Diabetes Research Foundation (“JDRF” and “the Organization”) and "____________________" (“I”).
1. I acknowledge that I understand that on March 13, 2020, a national emergency over the coronavirus pandemic was declared in the United States. Coronavirus disease (COVID-19) is a severe acute respiratory illness that can spread among humans through respiratory transmission and can cause a serious illness and even death. Despite the foregoing and despite the coronavirus pandemic and associated risks, I voluntarily choose to continue to attend "___________________________" (“Event Attendance”). I acknowledge, agree, and represent that my Event Attendance during the coronavirus pandemic is voluntary and is not required (expressly or otherwise) by JDRF. I fully understand that: (a) my Event Attendance during the coronavirus pandemic involves risks and dangers of serious COVID-19 illness, including death; and (b) these risks and dangers may be caused by my own actions or inactions and the actions or inactions of others around me during the coronavirus pandemic. I fully accept and assume all risks and all responsibility for losses, costs, and damages I incur if I become sick with COVID-19.
2. Therefore, for and in consideration of being permitted to voluntarily agree to my Event Attendance during the coronavirus pandemic, I, for myself, my personal representatives, assigns, heirs, and next of kin, hereby release and discharge the Organization, its chapters, their predecessors, successors, assigns, board members, officers, directors, agents, employees, volunteers, representatives, employee benefit plans and their administrators and trustees (collectively referred to as “Releasees”), individually and collectively, from all liability, injury, charges, costs, expenses, claims, demands, damages, and/or other loss related to me getting infected with COVID-19, known or unknown, suspected or unsuspected, caused or alleged to be caused in whole or in part by the negligence of the Releasees; and I further agree that that if, despite this Agreement I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save and hold harmless each of the Releasees from any and all liability, injury, charges, costs, expenses, claims, demands, damages, and/or other loss, including reasonable attorney’s fees and costs, which may incur as the result of such claim. I further release, indemnify, save and hold harmless the Releasees from any and all liability, injury, charges, costs, expenses, claims, demands, damages, and/or other loss, including reasonable attorney’s fees and costs, resulting from any suit or proceeding brought by any third party arising from or related to my getting infected with COVID-19.
I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
